A truly weird development out of Kentucky
Brian Keith Moore is on death row in Kentucky for a murder he says he didn’t commit.
In 2006, Moore became the first Kentucky death row inmate to win DNA testing when a judge ordered an examination of multiple pieces of clothing that the Commonwealth claims Moore was wearing when the murder was committed.
Lab techs discovered enough DNA to be tested, or so they announced two weeks ago. Under Kentucky law, however, the DNA testing was to be done in the Kentucky State Police Crime Lab.
The Louisville Courier Journal notes the Assistant Attorney General representing the Commonwealth ordered, apparently with a judge’s order, for the State Police Crime Lab to stop the testing just hours before the results were to be returned:
With Kentucky lab technicians just hours away from completing DNA testing that could exonerate death row inmate Brian Keith Moore in the 1979 murder of a Louisville man, the testing was halted at the request of state prosecutors last week, Moore’s attorney said.
Prosecutors with the state attorney general’s office asked the Kentucky State Crime Lab to stop tests on DNA evidence found on the clothing reportedly worn by the killer in the slaying of Virgil Harris, saying a DNA sample taken from Moore might not have been obtained properly.
You truly can’t make this stuff up.

Funny how the information was good enough to convict a person but now it isn’t good enough to exonerate?? Gee last I heard you can’t have your cake and eat it too.

I WAS A WITNESS AT THIS KILLER’S TRAIL BOTH TIMES AND HE WAS FOUND GUILTY AND GIVEN THE DEATH PENALTY BOTH TIMES. THE MAN HE CLAIMS IS THE REAL KILLER, I WAS WITH ALL DAY! I SAW MR. MOORE WITH THIS MAN’S CAR, THE GUN HE USED TO SHOOT HIM, THE MONEY HE STOLED, ETC. AS SURE AS THERE IS A GOD HE IS GUILTY AND DESERVES TO DIE.

Well Francis if you were there and know all that what the heck were you doing with this guy and how come you are not in jail with him? If you were with the supposed killer than how do you know all of the evidence is true if you were not at least with the guy when the murder happened? And it seems you and the actual killer Mr. Moore says is the killer are either trying to frame this guy because you know more than you are supposed to to just be a witness buddy. I’m a lawyer and never lost a case yet and this one has holes all in it starting with you Francis.

It don’t matter if DNA testing comes out in Mr. Moores’ favor they can still convict him. Look up a case in Syracuse, NY of a Calvin Moore (ironic) who was convicted of the murder of a woman prostitute any man could have killed even tho he passed a DNA Test, Fingerprints showed NOT to be his, passed Polygraph, and the witness got on stand and screamed over and over how dark it was outside and unsure of herself that it was even him YET he sits in jail for a murder that was never really proven that he actually did it because there is NO proof that points out he actually did. Point is we have an f’d up system in America and people that like to play GOD with the innocent lives.
